Supplementary Privacy Policy for  

Residents of California

This Supplementary Privacy Policy (the “California Notice”) supplements the information contained in PSLoved’s Privacy Policy and applies solely to all visitors, users, and others who reside in the State of California (“consumers” or “you”). We adopt this notice to comply with the California Consumer Privacy Act of 2018 (CCPA), as amended by the California Privacy Rights Act of 2020 (CPRA). Any capitalized but undefined terms in this Policy have the meanings set forth in the CPRA or the Privacy Policy, as applicable. References to the CCPA shall be understood as references to the CPRA.  References to the Website shall be understood as references to all services provided by PSLoved. 

Where noted in this Policy, the CCPA temporarily exempts personal information reflecting a written or verbal business-to-business communication (“B2B personal information“) from some of its requirements. Capitalized but undefined terms in this California Notice have the meanings set forth in the Privacy Policy. If the terms of this California Notice and the terms of the Privacy Policy are in conflict, the terms of this California Notice shall govern. 

Information We Collect 

We collect information that identifies, relates to, describes, references, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer, household, or device (“personal information“). Personal information does not include:

Use of Personal Information 

We may use, sell or share, or disclose the personal information we collect for one or more of the following purposes:  

We will not collect additional categories of personal information or use the personal information we collected for materially different, unrelated, or incompatible purposes without providing you notice and the opportunity to opt-out of such collection. 

 

Sharing Personal Information 

We may share your personal information by disclosing it to a third party for a business purpose. We only make these business purpose disclosures under written contracts that describe the purposes, require the recipient to keep the personal information confidential, and prohibit using the disclosed information for any purpose except performing their obligations under such written contracts. In the preceding twelve (12) months, Company has disclosed personal information for a business purpose to the categories of third parties indicated in the chart below. 

We may also share your personal information by sell or sharing it to third parties, subject to your right to opt-out of those sales. Our personal information sales do not include information about individuals we know are under age 16, and you always retain the ability to opt out. The CCPA prohibits a third party from reselling or sharing personal information unless you have received explicit notice and an opportunity to opt-out of further sales. Sensitive Information 

In order to provide you with our services, we must collect certain information that is considered “Sensitive Personal Information” under the CPRA. Sensitive Personal Information includes, but is not limited to:

When we collect your Sensitive Personal Information we will always (i) let you know why it was collected, and what purposes it will be used for, and (ii) provide you with an opportunity, both before and after collection of such data, to opt-out of the collection or use of your Sensitive Personal Information. Your Rights and Choices  

The CCPA provides consumers that are California residents with specific rights regarding their personal information. This section describes your CCPA rights and explains how to exercise those rights. 

Right to Know and Data Portability 

You have the right to request that we disclose certain information to you about our collection and use of your personal information over the past 12 months (the “right to know”). We may also provide information from beyond 12 months if it is not unduly burdensome for us to collect. Once we receive your request and confirm your identity (see Exercising Your Rights to Know or Delete), we will disclose to you:

Right to Delete  

You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions (the “right to delete”). Once we receive your request and confirm your identity (see Exercising Your Rights to Know or Delete), we will review your request to see if an exception allowing us to retain the information applies. We may deny your deletion request if retaining the information is necessary for us or our service provider(s) to:

Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, fulfill the terms of a written warranty or product recall conducted in accordance with federal law, or otherwise perform our contract with you. 
  1. Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities. 
  1. Debug products to identify and repair errors that impair existing intended functionality. 
  1. Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law. 
  1. Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et. seq.). 
  1. Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information’s deletion may likely render impossible or seriously impair the research’s achievement, if you previously provided informed consent. 
  1. Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us. 
  1. Comply with a legal obligation. 
  1. Make other internal and lawful uses of that information that are compatible with the context in which you provided it. 

We will delete or deidentify personal information not subject to one of these exceptions from our records and will direct our service providers, contractors, and any other entities with whom such information has been shared to take similar action.  

We do not provide these deletion rights for B2B personal information. 

Right to Opt out of Certain Automated Decision making and Profiling. 

Our Sites make use of certain automated decision-making algorithms which help to optimize how we provide our services to you by curating your user experience. Right to Correct 

You have the right to request that we correct any inaccurate personal information about you, taking into account the  nature of the personal information and of our use of such personal information. Upon receiving a request to correct inaccuracies from a verified person, we shall endeavor to correct the incorrect information as soon as is feasible unless an exception to our obligation to do so applies. 

Exercising Your Rights  

To exercise your rights to know or delete described above, please submit a request by either:

Response Timing and Format

We endeavor to substantively respond to a verifiable consumer request without undue delay and in any case within thirty (30) days of its receipt. If we require more time (up to another 30 days), we will inform you of the reason and extension period in writing. 

If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically, in the same format as the request you sent to us. 

Any disclosures we provide will only cover the 12-month period preceding our receipt of your request. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance, specifically [EXPECTED FORMAT DESCRIPTION]]. 

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.  

Personal Information Sales Opt-Out and Opt-In Rights 

If you are age 16 or older, you have the right to direct us to not sell or share your personal information at any time (the “right to opt-out”). We do not sell or share the personal information of consumers we actually know are less than 16 years old. Consumers who opt-in to personal information sales may opt-out of future sales at any time.
